1. Accuracy of Information

ESBAP's provider directory contains information about ABA organizations compiled from publicly available sources, self-reported data, and community contributions. While we strive to maintain accurate and current information, we make no warranties or representations regarding the completeness, accuracy, reliability, or currency of any information on the Site.

Directory data is provided on a best-effort basis. Organization profiles, ownership classifications, and related data points should be used as a starting point for your own research, not as a sole basis for making employment, enrollment, or treatment decisions. We encourage users to independently verify any information before relying on it.

2. User-Submitted Content

ESBAP may allow users to submit content, including but not limited to organization reviews, profile edits, and corrections. By submitting content to ESBAP, you agree that:

• Your submissions are truthful and based on your genuine experience or knowledge.
• You will not submit content that is defamatory, fraudulent, misleading, harassing, or otherwise unlawful.
• You grant ESBAP a non-exclusive, royalty-free, worldwide license to use, display, modify, and distribute your submitted content in connection with the Site and our services.
• ESBAP reserves the right to remove, edit, or decline to publish any user-submitted content at our sole discretion.
• You are solely responsible for the content you submit. ESBAP does not endorse or verify user-submitted reviews or edits.

3. Prohibited Use

You agree not to use the Site to:

• Scrape, harvest, or collect data from the Site using automated means (bots, crawlers, spiders) without our prior written consent.
• Reproduce, duplicate, or redistribute directory data for commercial purposes without authorization.
• Submit false, misleading, or malicious information about any organization or individual.
• Impersonate any person or entity, or falsely represent your affiliation with any organization.
• Attempt to gain unauthorized access to the Site's systems, databases, or services.
• Use the Site in any manner that could damage, disable, overburden, or impair its functionality.
• Use directory information to harass, intimidate, or threaten any organization or individual.

4. Intellectual Property

All content on the Site, including but not limited to text, design, logos, graphics, data compilations, and software, is the property of ESBAP or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our express written permission.

5. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ESBAP DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ESBAP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ESBAP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ESBAP'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

You agree to indemnify, defend, and hold harmless ESBAP and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your infringement of any third-party rights.
